1. About OurStay

OurStay provides an iOS app that helps users create group trips, browse hotel stays, swipe on options, and identify hotels that members of a group may agree on. Our website is provided for information, marketing, legal notices, and support only.

OurStay is a discovery and decision-making tool. We do not own, operate, manage, inspect, control, or provide hotels, accommodation, travel services, or booking services.

2. Acceptance of These Terms

By downloading, accessing, or using the OurStay app, you agree to these Terms.

If you download OurStay from the Apple App Store, your use of the app may also be subject to Apple's Standard End User License Agreement unless a custom licence is provided.

3. Hotel Information and Availability

Hotel details, photos, prices, availability, ratings, amenities, descriptions, and location information may be supplied by third parties and may change at any time.

We aim to present useful information, but we do not guarantee that hotel information is complete, accurate, current, or error-free. You should check all important details before booking.

4. Bookings and Third-Party Providers

If you choose to book a hotel or continue to a booking provider, your booking is made with the relevant hotel, travel provider, or booking platform. OurStay is not a party to that booking.

The third-party provider's own terms, cancellation policy, refund policy, payment terms, privacy policy, and customer support process will apply.

OurStay is not responsible for hotel quality, availability, cancellations, overbookings, refunds, price changes, fees, check-in issues, or disputes between you and a hotel or booking provider.

5. Group Trips and User Choices

OurStay helps groups make decisions, but it does not guarantee that every group member will agree, book, attend, pay, or follow through with a trip.

You are responsible for checking trip details, making final decisions, communicating with your group, and ensuring that any booking suits your needs.

6. Accounts, Invites, and Acceptable Use

You agree not to misuse OurStay. This includes:

• Using OurStay for unlawful, fraudulent, abusive, or harmful purposes.
• Sharing invite links with people who should not have access to a trip.
• Attempting to interfere with, scrape, reverse engineer, or disrupt the service.
• Uploading or sharing content that infringes rights, is misleading, or is offensive.
• Using OurStay in a way that could damage the app, users, website, or third-party providers.

7. Advertising and Affiliate Links

OurStay may show adverts, sponsored placements, affiliate links, or booking links. We may receive payment, commission, or other benefit if you view, click, or book through certain links.

We will aim to present advertising and commercial relationships responsibly, but third-party advertisers and providers are responsible for their own products, services, claims, and websites.

8. Payments

Unless clearly stated otherwise, OurStay does not process hotel booking payments. Payments for bookings are handled by the relevant third-party provider, hotel, or platform.

9. Intellectual Property

OurStay, including its name, logo, design, app interface, website, text, and branding, is owned by us or our licensors. You may not copy, reproduce, modify, or use OurStay branding without permission.

10. Service Availability and Changes

We may update, suspend, withdraw, or change OurStay at any time. We do not guarantee that the app or informational website will always be available, uninterrupted, secure, or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, OurStay will not be responsible for indirect, incidental, special, consequential, or loss-of-profit damages arising from your use of the app, informational website, hotel information, third-party links, or booking providers.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

12. Privacy

Our use of personal information is explained in our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, provide additional notice in the app or on the website.

14. Governing Law

These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws in your country require otherwise.
